1. About these terms
These terms govern Metrum: Metronome & Setlists (the “App”), provided by Marcin Karwat (the “Developer”), Marcin Karwat, Wojska Polskiego 27, 68-132 Sanice, Poland. Contact: metrum.metronome.contact@gmail.com.
By using the App, you agree to these terms. If you do not agree, stop using the App. Your mandatory legal rights remain protected regardless of these terms. Data handling is explained in our Privacy Policy.
2. Permission to use the App
The Developer grants you a non-exclusive licence to use the App on compatible devices, subject to these terms and the applicable Google Play purchase and distribution rules.
Personal and commercial music use are allowed. You may use Metrum for practice, rehearsals, paid gigs, performances, recording sessions, professional teaching and music lessons. Commercial use does not require a separate licence from the Developer.
You may not redistribute or sell copies of the App, bypass purchase protections, gain unauthorized access to accounts or systems, or intentionally disrupt the App or its services. Restrictions on modifying or reverse engineering the App apply only to the extent permitted by law and do not override applicable third-party software licences.
If you are not legally able to enter this agreement yourself, obtain the authorization of your parent or guardian where required by law.
3. Your content and intellectual property
You retain your rights in the songs, notes, setlists and other content you enter. You are responsible for having permission to use that content. You authorize only the processing and copying needed to store it locally and, when you enable sync, synchronize it with your Google Drive and devices. These terms do not transfer ownership of your content to the Developer.
The Developer retains rights in the original App software, design and branding. Third-party software, names and materials remain subject to their respective owners’ rights and licences.
5. Google Drive sync and your data
Cloud sync is optional and requires premium eligibility, a Google account, the App’s Google permissions, an internet connection and available Drive storage. Google’s terms also apply to your use of its services. Local features can be used without connecting Drive.
Sync stores and merges library records, arrangements, tags, setlists and practice history in the App’s hidden data folder in your own Google Drive. It is not a public song-sharing service. Sync may be delayed or fail because of connectivity, account permissions, storage limits, incompatible versions or service interruptions. Concurrent edits are merged and the resulting content may differ from a particular device’s earlier version.
Signing out or disabling sync stops subsequent sync but does not delete existing cloud or local copies. Changing the connected Google account can reset the visible local library before the other account’s data is imported. Check the connected account before syncing.
Deleting an item does not permanently erase all stored copies. Historical sync files and deletion records are retained until the hidden Drive data is removed. For complete removal, follow the data deletion instructions, including stopping sync on every device and clearing local and backup copies.
Keep independent copies of content important to your work, especially before changing accounts, clearing storage or installing a version that announces a data reset. This advice does not limit the Developer’s legal responsibilities or your rights to a remedy.
6. Availability and liability
The Developer will exercise reasonable care in providing the App. Continuous availability, perfect timing on every device and error-free operation cannot be guaranteed. Performance depends in part on your hardware, Android version and audio configuration.
Nothing in these terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any liability or statutory guarantee that cannot lawfully be excluded. Consumer rights concerning conformity, necessary updates, repair, price reduction, refunds and termination remain unaffected.
To the extent permitted by law, the Developer is not responsible for losses caused solely by events outside the Developer’s reasonable control or by your unlawful use of the App. This does not remove responsibility imposed by law for the Developer’s own acts or omissions.
7. Updates, changes and ending use
The App or these terms may be updated for specific reasons: fixing defects, improving security or compatibility, meeting legal requirements, responding to changes in Google or Android services, or improving features. Changes will not be used to remove your mandatory rights.
We will provide reasonable advance notice in the App for material changes to these terms, paid features or service availability. Where law requires, that notice will also be provided on a durable medium and explain the change, its timing and your available rights. Urgent security or legal action may require shorter notice.
Where a change negatively affects a paid digital service beyond what applicable law permits without a remedy, you retain the applicable rights to reject the change, terminate the affected agreement or obtain a refund. Continued use does not waive these rights. Paid functionality will not be withdrawn arbitrarily.
You may stop using the App at any time. The Developer may restrict access where reasonably necessary to address a material breach, unlawful activity or a security threat, with an explanation and an opportunity to remedy a breach where appropriate. Urgent measures may be taken where necessary to prevent harm. Any permanent discontinuation remains subject to applicable notice, refund and consumer obligations.
8. Questions, complaints and applicable law
Send questions, complaints or requests for remedies to metrum.metronome.contact@gmail.com, or write to Marcin Karwat, Wojska Polskiego 27, 68-132 Sanice, Poland. Describe the issue and include only information needed to investigate it. We will respond without undue delay and within any applicable statutory deadline.
These terms are governed by Polish law. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your country of habitual residence where those protections apply. You may bring proceedings in any court available to you under applicable law; these terms do not impose exclusive jurisdiction in Poland.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. These terms describe the agreement for using the App together with the purchase information presented at checkout; they do not override mandatory rights, binding purchase promises or applicable third-party licences.
